ITEM NO. (2)                        CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION

RECOMMENDATION for the City Council:

1.                  A closed session will be held, pursuant to Government Code 54956.9(a), to confer with legal counsel regarding pending litigation to which the City is a party.  The title of such litigation is as follows: State of California v. Commission on State Mandates, Case No. 34-2010-000605.

INVOCATION:

On May 16, 2006, the City Council unanimously approved the offering of a brief invocation at the commencement of all meetings of the City Council or Redevelopment Agency.  In doing so, the City Council is cognizant of its legal obligation to assure that such invocations are “legislative prayers,” and that they do not purport to advance any particular religion or religious denomination.

 

Consistent with the so-called “Burbank” prayer decision, the City Council hereby admonishes those who offer invocations to do so consistent with the current state of the law – meaning that an invocation must not be used to identify, advance, or urge a particular religious denomination, or identify a specific religion’s deity.  This evening we are pleased that our invocation will be offered by:

ITEM NO. (6)                        CONSIDERATION OF RESOLUTION NO. 11-121 URGING THE BOEING COMPANY UPGRADE THE 737 MODEL AIRPLANE AT THE LONG BEACH BOEING FACILITY (CITY MANAGER)

RECOMMENDATION for the City Council:

TAKE the following actions:

1.                  WAIVE further reading and ADOPT Resolution No. 11-121, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, URGING THE BOEING COMPANY TO UPGRADE THE 737 MODEL AIRPLANE AT THE LONG BEACH BOEING FACILITY."

2.                  DIRECT staff to transmit an executed copy of the resolution to the Mayor, City Councilmembers and City Manager of the City of Long Beach and Jim McNerney, Chairman/President & CEO of The Boeing Company, 100 N. Riverside, Chicago, IL 60606.

(8)                        CONSIDERATION OF RESOLUTION NO. 11-127 ESTABLISHING AND DECLARING THE POLICY OF THE CITY OF CARSON TO IDENTIFY, CONTACT, AND ENCOURAGE LOCAL ARCHITECTURAL, ENGINEERING, SURVEYING, AND OTHER TECHNICAL PROFESSIONALS TO SUBMIT PROPOSALS FOR PUBLIC WORKS AND PROFESSIONAL SERVICES CONTRACTS (CITY MANAGER)

RECOMMENDATION for the City Council:

1.                  WAIVE further reading and ADOPT Resolution No. 11-127, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, ESTABLISHING AND DECLARING THE POLICY OF THE CITY OF CARSON TO REQUIRE THE IDENTIFICATION, SOLICITATION, AND INVITATION OF CARSON-BASED ARCHITECTURAL, ENGINEERING, SURVEYING AND OTHER TECHNICAL PROFESSONALS TO SUBMIT PROPOSALS, EITHER INDIVIDUALLY OR IN COMBINATION WITH OTHER TECHNICAL PROFESSIONALS, IN RESPONSE TO VARIOUS NOTICES INVITING PROPOSALS FOR CERTAIN PROFESSIONAL SERVICES AND OTHER PUBLIC WORKS CONTRACTS ISSUED BY THE CITY OF CARSON."

ITEM NO. (9)                        CONSIDERATION OF A REQUEST FOR AUTHORIZATION TO ACCEPT AND APPROPRIATE VARIOUS DONATIONS IN THE GENERAL FUND (ADMINISTRATIVE SERVICES)

RECOMMENDATION for the City Council:

TAKE the following actions:

1.                  ACCEPT the donations received in August 2011 in the amount of $5,550.00.

2.                  APPROVE an increase in the FY 2011/12 General Fund revenue budget by $5,550.00.

3.                  APPROPRIATE the $5,550.00 to the FY 2011/12 expenditure budget in the account numbers listed in Exhibit No. 1.

4.                  APPROVE the transfer of $2,919.81 of unused funds in the Juneteenth account to the Jazz Festival account.

ITEM NO. (10)                    CONSIDERATION OF RESOLUTION NO. 11-123 EXTENDING THE TEMPORARY SUSPENSION OF THE "CAP" ON THE MAXIMUM TAX TO BE PAID UNDER THE CARSON UTILITY USERS TAX ORDINANCE (ADMINISTRATIVE SERVICES)

RECOMMENDATION for the City Council:

1.                  WAIVE further reading and ADOPT Resolution No. 11-123, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, FINDING AND DETERMINING TO EXTEND THE TEMPORARY SUSPENSION OF THE EXEMPTION SET FORTH IN SECTION 61104(e) OF ARTICLE VI, CHAPTER 11 OF THE CARSON MUNICIPAL CODE ESTABLISHING A TWO PERCENT TAX ON ELECTRIC AND GAS UTILITY USERS."

ITEM NO. (11)                    CONSIDER STAFF'S REQUEST TO EXTEND THE PERIOD TO EXCLUSIVELY NEGOTIATE WITH JAY'S CATERING TO DEVELOP A CATERING CONTRACT FOR THE CONGRESSWOMAN JUANITA MILLENDER-MCDONALD COMMUNITY CENTER  (PUBLIC SERVICES)

RECOMMENDATION for the City Council:

1.                  APPROVE staff's request to extend the negotiation period to November 30, 2011, for City officials and Jay's Catering to negotiate a catering contract for the Congresswoman Juanita Millender-McDonald Community Center.

1.                  AUTHORIZE the city to serve as the fiscal agent for the Senior Center Winter Holiday Party by selling tickets, collecting ticket revenue, depositing the funds with the City Treasurer's Office, and paying vendors.
