ITEM NO. (5) AWARD OF WORKER COMPENSATION THIRD PARTY ADMINISTRATOR CONTRACT FOR FY 2013/14 AND FY 2014/15 (CITY MANAGER)

1. WAIVE the proposal process as defined by Carson Municipal Code Section 2610(a).
2. AWARD a two-year contract for Third Party Administrator services with Tristar for FY 2013/14 in the amount of $120,000.00 and for FY 2014/15 in the amount of $122,400.00.
3. AUTHORIZE the Mayor to sign the two-year contract after approval as to form by the City Attorney.

RECOMMENDATION for the City Council:
1. WAIVE further reading and ADOPT Resolution No.13-022, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AMENDING THE CLASSIFICATION PLAN, RESOLUTION NO.77-111, BY ADOPTING A PUBLIC WORKS OPERATIONS MANAGER JOB SPECIFICATION."

1. AUTHORIZE the funding for a construction contract for a commercial façade improvement project located at 621 W. Carson Street in the amount of $34,860.00.
2. AUTHORIZE the Mayor to execute the Façade Improvement Program Agreement between the City and the property owner following the funding approval and approval as to form by the City Attorney.

RECOMMENDATION for the City Council:
1. WAIVE further reading and ADOPT Resolution No. 13 018, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AUTHORIZING THE EXECUTION OF PROGRAM SUPPLEMENT AGREEMENT NO. N014 TO ADMINISTERING AGENCY-STATE MASTER AGREEMENT NO. 07-5403R FOR FEDERAL AID PROJECTS COVERING THE CONSTRUCTION PHASE OF PROJECT NO. 919 [FEDERAL NO. HPLUL 5403(017)]: WILMINGTON AVENUE INTERCHANGE MODIFICATION AT THE I-405 FREEWAY."

TAKE the following actions:
1. AWARD a Construction Contract for Project No. 999: Dolphin Park Improvements - Phase I, in the amount of $195,800.00, to the lowest responsible bidder, Rafael 26 Construction, Inc.
2. AUTHORIZE the expenditure of a construction contingency, if necessary, in an amount not-to-exceed $29,370.00 (15%) for change orders such as the removal and remediation of contaminated soil, substructure conflicts, and other unforeseen construction work that may be required to complete this project.
3. AUTHORIZE the Mayor to execute the Construction Contract following approval as to form by the City Attorney.

RECOMMENDATION for the City Council:
TAKE the following actions:
1. APPROVE the plans, specifications, estimates, Location Maps and Location List, and order the work for Project No. 1338: Citywide Rubberized Slurry Seal FY 2012/13.
2. MAKE the California Environmental Quality Act finding that the proposed Citywide Rubberized Slurry Seal is categorically exempt pursuant to Section 15301, 15301(c) and 15301(d) of the California Environmental Quality Act guidelines.
3. AUTHORIZE staff to record the "Notice of Exemption" in the office of the Los Angeles County Clerk for Project No. 1338: Citywide Rubberized Slurry Seal FY 2012/13.
4. WAIVE the formal bid process defined by the Carson Municipal Code, Section 2607, as allowed by Section 2604(d).
5. AUTHORIZE the City of Carson to piggy back off of a competitively bid contract between the City of Los Angeles and Petrochem Manufacturing, Inc.
6. APPROPRIATE $100,000.00 from the Measure "R" Local fund balance for Project No. 1338: Citywide Rubberized Slurry Seal FY 2012/13.
7. AWARD a construction and materials purchase contract to Petrochem Manufacturing, Inc., in the amount of $405,859.00 for Project No. 1338: Citywide Rubberized Slurry Seal FY 2012/13.
8. AUTHORIZE the Mayor to execute the construction and materials purchase contract following approval as to form by the City Attorney.

TAKE the following actions:
