RECOMMENDATION for the City Council:

1.                  A closed session will be held, pursuant to Government Code § 54956.9(d)(1), to confer with legal counsel regarding pending litigation to which the City is a party.  The title of such litigation is as follows: Carson Harbor Village, Ltd. vs. City of Carson; Los Angeles Superior Court Case No. BS133538.

INVOCATION:        On May 16, 2006, the City Council unanimously approved the offering of a brief invocation at the commencement of all meetings of the City Council or Redevelopment Agency.  In doing so, the City Council is cognizant of its legal obligation to assure that such invocations are “legislative prayers,” and that they do not purport to advance any particular religion or religious denomination.

 

Consistent with the so-called “Burbank” prayer decision, the City Council hereby admonishes those who offer invocations to do so consistent with the current state of the law – meaning that an invocation must not be used to identify, advance, or urge a particular religious denomination, or identify a specific religion’s deity.  This evening we are pleased that our invocation will be offered by:  PASTOR JOEL WOOD, CARSON BIBLE CHURCH

ITEM NO. (4)                        AUTHORIZE TRANSFER OF CITY OF CARSON-OWNED PROPERTY AT 401 E. CARSON STREET TO THE CARSON SUCCESSOR AGENCY (COMMUNITY DEVELOPMENT DEPARTMENT) THIS IS A COMPANION AGENDA ITEM WITH  CARSON SUCCESSOR AGENCY ITEM NO. 1

RECOMMENDATION for the City Council:

TAKE the following actions:

1.                  APPROVE transfer of the property at 401 E. Carson Street to the Carson Successor Agency.

2.                  AUTHORIZE the Mayor to execute the Quitclaim Deed transferring the property at 401 E. Carson Street to the Carson Successor Agency following approval as to form by the City Attorney.

ITEM NO. (5)                        AWARD OF WORKER COMPENSATION THIRD PARTY ADMINISTRATOR CONTRACT FOR FY 2013/14 AND FY 2014/15 (CITY MANAGER)

RECOMMENDATION for the City Council:

TAKE the following actions:

1.                  WAIVE the proposal process as defined by Carson Municipal Code Section 2610(a). 

2.                  AWARD a two-year contract for Third Party Administrator services with Tristar for FY 2013/14 in the amount of $120,000.00 and for FY 2014/15 in the amount of $122,400.00.

3.                  AUTHORIZE the Mayor to sign the two-year contract after approval as to form by the City Attorney.

ITEM NO. (6)                        RESOLUTION NO. 13-022 AMENDING THE CLASSIFICATION PLAN, RESOLUTION NO. 77-111, BY ADOPTING A JOB SPECIFICATION FOR A PUBLIC WORKS OPERATIONS MANAGER (CITY MANAGER)

RECOMMENDATION for the City Council:

1.                  WAIVE further reading and ADOPT Resolution No.13-022, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AMENDING THE CLASSIFICATION PLAN, RESOLUTION NO.77-111, BY ADOPTING A PUBLIC WORKS OPERATIONS MANAGER JOB SPECIFICATION."

ITEM NO. (8)                        CONSIDER AUTHORIZATION TO FUND A CONSTRUCTION CONTRACT FOR THE COMMERCIAL FACADE IMPROVEMENT PROJECT LOCATED AT 621 W. CARSON STREET (COMMUNITY DEVELOPMENT DEPARTMENT)

RECOMMENDATION for the City Council:

TAKE the following actions:

1.                  AUTHORIZE the funding for a construction contract for a commercial façade improvement project located at 621 W. Carson Street in the amount of $34,860.00.

2.                  AUTHORIZE the Mayor to execute the Façade Improvement Program Agreement between the City and the property owner following the funding approval and approval as to form by the City Attorney.

ITEM NO. (9)                        CONSIDERATION OF RESOLUTION NO. 13-018, AUTHORIZING THE EXECUTION OF PROGRAM SUPPLEMENT AGREEMENT NO. N014 TO ADMINISTERING AGENCY-STATE MASTER AGREEMENT NO. 07-5403R FOR FEDERAL AID PROJECTS COVERING THE CONSTRUCTION PHASE OF PROJECT NO. 919 [FEDERAL NO. HPLUL-5403 (017)]:  WILMINGTON AVENUE INTERCHANGE MODIFICATION AT THE I-405 FREEWAY (PUBLIC WORKS DEPARTMENT)

RECOMMENDATION for the City Council:

1.                  WAIVE further reading and ADOPT Resolution No. 13 018, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AUTHORIZING THE EXECUTION OF PROGRAM SUPPLEMENT AGREEMENT NO. N014 TO ADMINISTERING AGENCY-STATE MASTER AGREEMENT NO. 07-5403R FOR FEDERAL AID PROJECTS COVERING THE CONSTRUCTION PHASE OF PROJECT NO. 919 [FEDERAL NO. ITEM NO. (10)                    CONSIDER AN AWARD OF A CONSTRUCTION CONTRACT FOR PROJECT NO. 999:  DOLPHIN PARK IMPROVEMENTS - PHASE I (PUBLIC WORKS DEPARTMENT)

RECOMMENDATION for the City Council:

TAKE the following actions:

1.                  AWARD a Construction Contract for Project No. 999:  Dolphin Park Improvements - Phase I, in the amount of $195,800.00, to the lowest responsible bidder, Rafael 26 Construction, Inc.

2.                  AUTHORIZE the expenditure of a construction contingency, if necessary, in an amount not-to-exceed $29,370.00 (15%) for change orders such as the removal and remediation of contaminated soil, substructure conflicts, and other unforeseen construction work that may be required to complete this project.

3.                  AUTHORIZE the Mayor to execute the Construction Contract following approval as to form by the City Attorney.

ITEM NO. (11)                    CONSIDER APPROVAL OF PLANS, SPECIFICATIONS AND ESTIMATES, AND AWARD OF A CONSTRUCTION AND MATERIALS PURCHASE CONTRACT FOR FOUR RUBBERIZED SLURRY SEAL PROJECTS WITHIN THE CITY OF CARSON (PUBLIC WORKS DEPARTMENT)

RECOMMENDATION for the City Council:

TAKE the following actions:

1.                  APPROVE the plans, specifications, estimates, Location Maps and Location List, and order the work for Project No. 1338:  Citywide Rubberized Slurry Seal FY 2012/13.

2.                  MAKE the California Environmental Quality Act finding that the proposed Citywide Rubberized Slurry Seal is categorically exempt pursuant to Section 15301, 15301(c) and 15301(d) of the California Environmental Quality Act guidelines.

3.                  AUTHORIZE staff to record the "Notice of Exemption" in the office of the Los Angeles County Clerk for Project No. 1338:  Citywide Rubberized Slurry Seal FY 2012/13.

4.                  WAIVE the formal bid process defined by the Carson Municipal Code, Section 2607, as allowed by Section 2604(d).

5.                  AUTHORIZE the City of Carson to piggy back off of a competitively bid contract between the City of Los Angeles and Petrochem Manufacturing, Inc.

6.                  APPROPRIATE $100,000.00 from the Measure "R" Local fund balance for Project No. 1338:  Citywide Rubberized Slurry Seal FY 2012/13.

7.                  AWARD a construction and materials purchase contract to Petrochem Manufacturing, Inc., in the amount of $405,859.00 for Project No. 1338:  Citywide Rubberized Slurry Seal FY 2012/13.

8.                  AUTHORIZE the Mayor to execute the construction and materials purchase contract following approval as to form by the City Attorney.

ACTION:

ITEM NO. (12)                    CONSIDER APPROVAL OF PLANS, SPECIFICATIONS, AND ESTIMATES AND AUTHORIZATION TO ADVERTISE FOR CONSTRUCTION BIDS FOR PROJECT NO. 1362 [FEDERAL NO. STPL-5403(024)]:  FIGUEROA STREET PAVEMENT RESTORATION FROM THE I-405 FREEWAY TO VICTORIA STREET (PUBLIC WORKS DEPARTMENT)

RECOMMENDATION for the City Council:

TAKE the following actions:

1.                  APPROVE the plans, specifications and estimates, and order the work for Project No. 1362:  Figueroa Street Pavement Restoration from the I-405 Freeway to Victoria Street.

2.                  MAKE the California Environmental Quality Act finding that the proposed Figueroa Street Pavement Restoration from the I-405 Freeway to Victoria Street is categorically exempt pursuant to Section 15301, 15301(c) and 15301(d) of the California Environmental Quality Act guidelines.
