City of Carson Report to Mayor and City Council March 1,2005 Special Orders of the Day SUMMARY Pursuant to the California Vehicle Code (CVC) section 21107.9(b), the owners' representative of Country Estate Mobile Homes has petitioned the City Council to pass a resolution that subjects the roads within the park to the provisions of the CVC. The petitioner has determined that enforcement of the CVC is necessary due to increasing instances of unsafe driving conditions and the increasing number of unlicensed drivers in the mobilehome park operating motor vehicles, thereby compromising the safety of the residents and property of the mobilehome park. The Sheriffs Department cannot enforce the CVC unless the City Council passes the appropriate resolution. RECOMMENDATION TAKE the following actions: 1. OPEN the public hearing, TAKE public testimony, and CLOSE the public hearing. 2. WAIVE further reading and ADOPT Resolution No. 05-015, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, FINDING AND DETERMINING THAT THE PUBLIC HEALTH, SAFETY, AND GENERAL WELFARE WARRANT DECLARING THE PRIVATE ROADWAYS WITHIN COUNTRY ESTATE MOBILE HOMES BE SUBJECT TO THE PROVISIONS OF THE CALIFORNIA VEHICLE CODE (CVC) AND DIRECTING THE LOS ANGELES COUNTY SHERIFF'S DEPARTMENT TO ENFORCE SUCH CODE ON AND WITHIN THE PRIVATE ROADWAYS IN COUNTRY ESTATE MOBILE HOMES AS ALLOWED BY CALIFORNIA VEHICLE CODE § 21107.9." ALTERNATIVES The City Council may take any other appropriate action.
