1. Call to Order and Roll Call

a. Approval of Absences

Ř      Committee member Neva Rogers was not in attendance; her absence was excused in advance.

 

b. Approval of Agenda

Ř      No changes were made to the agenda; agenda stood as posted. 

 

2.     Approval of Minutes

a. Minutes from April 25, 2002

b. Minutes from May 2, 2002

c. Minutes from May 16, 2002

Ř      Motioned by Committee Member Isaac Canales, and seconded by Committee Member Dennis Caulkins, the minutes for the above three meetings were approved unanimously.   

 

3.     Public Comments

Ř      Comment cards were submitted by the public to the Chair and the public commented on the Proposed Redevelopment Project Area and the Redevelopment Process.  All public comments were recorded by staff and will be part of the official record for Proposed Project Area 4.

 

4.    Reports

Ř      None

                       

5.     Old Business

a.Continued Eminent Domain Alternatives Discussion and Recommendations

Ř      The Project Area Committee discussed at length a recommended Eminent Domain policy to include in the Redevelopment Plan.  The Eminent Domain policy language was changed and then subdivided into 3 sections: A, B, and C; a vote was then cast on each section.  The vote was the following:

-         Section A – Motioned by Committee Member Joe Acosta, seconded by Committee Member Brad Pearl – passed unanimously.

-         Section B – Motioned by Committee Member Isaac Canales, seconded by Committee Member Brad Pearl – passed unanimously

-         Section C – Motioned by Committee Member Brad Pearl, seconded by Committee Member Isaac Canales,  passed unanimously

 

The PAC then directed staff to insert the changed/approved Eminent Domain Policy into the Draft Redevelopment Plan so that the PAC could make a recommendation on the Draft Redevelopment Plan during its next meeting (June 13).  The approved eminent domain language is printed below:

 

a) No eminent domain proceeding to acquire real property within the Project Area shall be commenced after twelve (12) years following the date of adoption of the ordinance approving and adopting this Plan.  Such time limitation may be extended only by amendment of this Plan.

 

b) No eminent domain proceeding to acquire real property within the Project Area shall be commenced against any residentially zoned property or any property on which a person or persons reside, except if pursuant to the Carson Municipal Code, such person or persons reside in a caretaker’s or superintendent’s residence which is a minor use related to and incidental to the principal industrial use on the same site.  This prohibition shall not apply to any mobile home park or trailer park if less than ten percent (10%) of the spaces in such mobile home park or trailer park are occupied.

 

c) Subject to paragraph (b), above, the maximum aggregate amount of commercially or industrially zoned property that the Agency may acquire by eminent domain, as evidenced by one or more final judicial orders of condemnation, shall not exceed fifty (50) acres.

  

b.Continued Redevelopment Plan Discussion and Recommendations

Ř      PAC/Redevelopment consultant Ernie Glover finished his chapter-by-chapter review of the Draft Redevelopment Plan.  The PAC suggested changes during this review.  The PAC advised staff to make the changes to the Draft Redevelopment Plan so the PAC could take action on the Plan during its next scheduled meeting on June 13.

Ř      Due to time constraints and the Carson Community Center closing, the discussion of items c, d, e, and f will be placed on the agenda for the June 13 meeting and discussion of these items will be taken up then.

Ř   Note: the June 13 PAC Meeting will take place at the Carson Hilton (2 Civic Center Drive, Carson, CA.) and not the Carson Community Center.
