JUDGE DISMISSES CAM-CARSON’S (SIMON & MACERICH) $80 MILLION LAWSUIT AGAINST CITY OF CARSON

Los Angeles County Superior Court Judge Maureen Duffy-Lewis this morning (March 15, 2021) granted a motion made by the City of Carson and the Successor Agency to the Carson Redevelopment Agency, resulting in their dismissal from the case filed for over $80 Million in damages by Simon Property Group and Macerich Properties (operating as a joint venture known as CAM-Carson, LLC).

CAM-Carson’s complaint alleged the City, the Successor Agency and the Carson Reclamation Authority (CRA) all had breached a contract providing for the remediation of the 157 acre former Cal Compact landfill in connection with the development of the CAM-Carson’s Los Angeles Premium Outlets high-end outlet mall project. CAM-Carson also alleged the City, the Successor Agency and the CRA were negligent in their management of the project and that they had breached the covenant of good faith and fair dealing.

The Court rejected CAM-Carson’s theory and dismissed in its entirety the case against City and the Successor Agency. Further, the Court found CAM-Carson as a matter of law cannot allege negligence or breach of the covenant of good faith and fair dealing against the CRA.

The granting of the motion on the grounds adopted by the Court brings the involvement of the City and the Successor Agency in the case to a close. “We are very pleased with this outcome,” said Mayor Lula Davis-Holmes. “This result is what our City Attorney predicted when the case was first filed -that the City and Successor Agency would be dismissed because CAM-Carson’s complaint was frivolous.” “Clearly, with their frivolous lawsuit Simon and Macerich had hoped to pressure the City into getting out of their contractual obligations. CAM-Carson now has a decision to make: to perform its duties under the contract and develop the outlet mall or market the property jointly with the CRA and allow for a new developer to step in.”
